Do the owners own the land, or is it under a 99-year lease?
The property and its domiciles are registered in a Mozambican Legal entity, of which directors and shareholders can be amended, added, and changed at any time.
The second portion with the swimming pool and staff quarters have been purchased and agreements in place. Registration has just not yet been verified. With all the paperwork in hand and with a lawyers assistance, this can be registered into the name of the company.
How can the rights, title deeds, and building plans be verified?
Yes. All documentation, ‘alvara', ‘duat', etc. are in place and registered to the business. Building plans are up to date and approved by the local authorities, and all tax and INSS paperwork is up to date.
How does the transfer process work?
Each application could be different depending on the buyer's requirements. It will usually be handled by a Mozambican Attorney who will handle most of the processes. An agreement will be drafted and signed, payment will be made, and then the property will be transferred. It is mostly the same as other countries, except that all paperwork is done IN PERSON and must be original documentation. This mitigates fraudulent transactions.
Is there VAT on the transaction?
Yes, but that is an amount for the seller's account unless otherwise described in the purchase agreement. The buyers pay SISA, which is 2% of the sale value.
