IN THE CURRENT MARKET |

The
rental market forms an important
component of the residential
property market and when there
is an oversupply of stock for
sale, this sector of the market
often gains momentum.
Legalities
“However, it is vital
that both tenants and landlords
remain mindful of the legalities
pertaining to residential letting
in South Africa,” says
Carol Reynolds, area principal
for Pam Golding Properties in
the Durban North and La Lucia
areas. Lease
Agreements “This
is particularly relevant in
the current economic climate,
where the strict lending conditions
have forced many would-be-purchasers
to rent rather than to buy.
Lease agreements are, however,
not to be taken lightly, and
professional service and expertise
can make the difference between
a pleasant experience and a
tumultuous one. Obligations
“Most importantly, a lease
agreement is a legally-binding
document and once signed, the
parties are obligated to perform
in accordance with the terms
of the agreement. The tenant
commits for the full term of
the lease, and generally rent
is due on or before the first
day of every month. |

Arrears
“Unfortunately, the
current economic situation has resulted
in a large number of tenants falling
into arrears with their rental payments.
The correct process for a landlord
to follow under these circumstances
is to send a letter of demand notifying
the tenant of the fact that he/she
is in breach of contract, offering
the tenant seven days within which
to contact the landlord and to make
arrangements to remedy the breach.
Blacklisting
“If payment has not been forthcoming
within 20 days, then the landlord
is entitled to blacklist the tenant.
The blacklisting can only be removed
once the debt has been settled. This
has serious implications for an individual’s
credit worthiness, and can hamper
prospects of finding alternative premises
to lease. If for any reason, a tenant
wishes to vacate the premises prior
to termination of the lease agreement,
then the tenant is still liable to
pay the rent, until such time as a
replacement tenant has been found.”
Deposit Usage
Reynolds says other basic rules to
keep in mind include the fact the
deposit cannot be offset against the
last month’s rental. The deposit
is the landlord’s only security
and is strictly to be utilised for
repairs regarding any damages that
may have ensued during the term of
the lease. Lease
Expiration
Once a lease has expired, and should
the landlord and tenant then decide
to enter into a month-to-month agreement,
they need to inform the agent of their
intentions, and the agent will normally
agree to a reduced renewal fee for
assisting them in regard to any legalities.
Eviction
“From a landlord’s
perspective, the current legislative
process of evicting a problematic
tenant is onerous. This is why
it is vital to employ the services
of a reputable estate agent.

Agent Services
Landlords are fully entitled to do
their homework before enlisting the
services of an agent, and they should
consider factors such as: •
Experience; • The reputation
or track record of the estate agency
and follow-up service; •
Costs payable for services rendered;
whether the agency offers credit checks
and tenant screening; procedures regarding
invoicing, •
inspections and debt-collection.

Just
because you live in rented accommodation,
doesn't mean you can't put your
own personal touches to your
home.
Design Changes
So says Dexter Leite, Pam Golding
Properties' rentals director
for the Western Cape, who believes
tenants can make design changes
to their homes without falling
foul of their landlords or leases.
"Putting one's personal
stamp on one's place of residence
is an important part of making
it feel like home," says
Leite. Good
Communications
"But it's important that
tenants are clear from the start
on what they may or may not
do. Good communication upfront
between tenant and landlord
can prevent unpleasant clashes
at the end of the tenancy agreement."
Personal Touch
Allowances
The easiest way to put your
personal stamp on your home
without interfering with the
landlord's property is by using
moveable and soft furnishings.
Your own choice of lampshades,
floor-rugs, cushions and paintings
can all be removed when it's
time for you to move out, leaving
the owner's permanent fittings
in place. |
Paintwork
But it gets more difficult when it
comes to more permanent or longer-lasting
changes, says Leite, for example,
paintwork. “If you want to paint
your walls an unusual colour, by all
means discuss it with your landlord.
But be prepared for the possible condition
that you return the walls to their
original state when you move out and
that will mean extra expense.
Light Fixtures
Likewise if you want to install your
own light fixtures, you can probably
do so, but make sure you store the
owners' original fittings safely,
so that you can replace them when
you move out," says Leite. “The
owner cannot argue with your personal
taste, so long as you return the property
to him or her in the same condition
in which you first occupied it.”
Permanent Changes
If you are installing fittings that
will stay behind when you move on,
you also need to negotiate whose expense
this will be. For example, if you
want to install a dishwasher and extra
plumbing is needed, you need to discuss
this upfront with the landlord, clarifying
who will bear the costs.

Garden
Likewise if you want to replace
fittings like pelmets, make
sure you agree upfront who will
pay for the changes, and who
will own the new product. “And
remember that most leases don’t
permit changes to the garden,”
says Leite, “so be very
cautious about investing in
new plants or the like, unless
these are moveable pot plants
that you can take away with
you when you move out.”
Water-tight Lease
The easiest way to ensure that
design changes don't become
a point of contention is to
have a water-tight lease, Leite
concludes. “Having a good
lease drawn up by a professional
rental agency ensures that both
tenant and landlord are fully
aware of their rights and responsibilities
upfront. Landlord

All too often tensions occur
when tenants try to renegotiate
the terms after the agreement
has already been signed, but
if you start with a well-constructed,
professional agreement upfront,
then negotiating any additional
requests is that much easier. |

Conclusion
Remember too that if a landlord doesn’t
want to agree to extra expenditure,
that is his right, and he is also
under no obligation to approve any
requests for design changes,”
he cautions. “It is at the end
of the day his property.”
